Deux Iraniens condamnés à la lapidation libérés par l'autorité judiciaire

TEHERAN, 5 oct 2009 - Un homme et une femme condamnés pour adultère à la peine de mort par lapidation à Ispahan, dans le centre de l'Iran, ont été libérés après six années passées en prison, le verdict ayant été annulé par le chef de l'autorité judiciaire, a rapporté lundi l'agence Ilna.

Ilna, qui identifie l'homme comme étant Gholam Ali Eskandari et la femme comme Gilan Mohammadi, précise que le chef de l'autorité judiciaire (l'hojatoleslam Sadeq Larijani) a pris sa décision à la suite d'un appel des avocats des condamnés.

Ces derniers ont été libérés dimanche, ajoute Ilna, sans expliquer les raisons de l'annulation de la peine.

En août 2008, les autorités judiciaires iraniennes avaient annoncé que la lapidation allait être rayée du nouveau code pénal islamique, dont les grands traits ont été adoptés par le Parlement mais dont les dispositions spécifiques doivent encore être débattues par les députés.

Le meurtre, le viol, le vol à main armée, le trafic de drogue, l'adultère, l'apostasie, la prostitution, la haute trahison et l'espionnage sont passibles de la peine de mort en Iran.

Le code pénal encore en vigueur prévoit la mort par lapidation pour les auteurs d'adultère, et les exécutions sont publiques. Les hommes sont enterrés jusqu'à la taille, les femmes jusqu'aux épaules, les condamnés étant épargnés s'ils parviennent à se libérer. Cette pratique a été condamnée par la communauté internationale, l'ONU et l'Union européenne appelant à son abolition. Des défenseurs iraniens des droits de l'Homme ont également demandé aux autorités de l'abolir.

TEHERAN, 6 OTT - Un uomo e una donna iraniani gia' condannati a morte per adulterio tramite lapidazione, sono stati graziati e rilasciati dopo sei anni di carcere per intervento del capo dell'apparato giudiziario. Lo scrive oggi il quotidiano Etemad Melli.

L'uomo, Gholamali Eskandari, e la donna, Gilan Mohammadi, che oggi ha 30 anni, erano rinchiusi dal 2003 nella prigione di Isfahan.

Nel 2002 l'allora capo dell'apparato giudiziario, Mahmud Hashemi Shahrudi, aveva emesso un'ordinanza che sospendeva le esecuzioni delle lapidazioni, previste dalla legge islamica per gli adulteri. Ma nonostante quell'intervento, almeno cinque sentenze di questo genere sono state eseguite in questi sei anni. L'ultima di cui si e' avuta notizia risale al maggio scorso, quando fu messo a morte un uomo a Rasht, nel nord dell'Iran.

Etemad non scrive se la coppia rilasciata a Isfahan sia stata graziata da Shahrudi, rimasto in carica fino a meta' agosto, o dal suo successore, l'ayatollah Sadeq Larijani.
