LIFE OF CARL HENRY BLUE, SENTENCED TO DEATH

Dear Board Members,
I am writing to express my deep concern over a ruling that sentenced to death Mr. Carl Henry Blue, in spite of the absence of premeditation in his crime, the evident racial prejudice emerged against him during his first trial and his proved mental retardation.
I urge you to intervene on his behalf to prevent this cruel and inhuman punishment from being meted out against him.
I hope you may consider:

1) that there is an inherent conflict of interest if the appellate counsel is from the same public defender's office;
2) that the trial counsel failed to investigate the defendant's
background for mitigating evidence.

I implore you therefore to ensure that this cruel and inhuman sentence
is nor carried out.Respectfully yours

His story

Carl received his capital sentence in 1995 for causing the death of his then girlfriend, Carmen Richard Sanders. At the moment of the crime, the man was under the effect of alcohol and drugs. He has been always maintaining that the murder happened in a completely accidental way, without any premeditation. His trial was strongly tainted by the presence of a psychologist, called by the state of Texas to give his testimony. Among other things, he said that Carl’s afro-American race must have been to take into consideration, because it showed a “propensity to violence”. In 2001 his sentence was reduced to life prison, but it was soon contested by a judge, who established again the death penalty for him. Afterwards Carl was also given a light mental retardation, anyway enough to make unconstitutional his capital sentence. Along these years Carl has deeply changed: as a loving father, he has seen growing up his own family, he has been near to his sons, he proved to have perfectly rehabilitated himself. Nevertheless, his execution is tragically set on February 21st 2013.
