Three men spared death penalty, get life term

KARACHI: A full bench of the Supreme Court of Pakistan, partly allowing the appeal by three convicts on a death row, modified their sentence to life imprisonment, on Monday.

The apex court bench comprising Justice Anwar Zaheer Jamali, Justice Khilji Arif Hussain and Justice Rehmat Hussain Jaffery heard appeals filed by Shirazul Haq, Qari Ghulam Yasin and Shiraz Ahmed, who were convicted and sentenced to death by an anti-terrorism court.

According to the prosecution, they abducted Akbar Ali, son of the complainant, Saifullah. The accused demanded a ransom of Rs 20 million and later released the victim after receiving Rs 470,000. They were later arrested and put to trial.

The bench, after hearing the counsel for the appellants, modified the death sentence to life term.

SHC seeks entire record of teachers’ appointments: The entire record of tests, interviews and other procedure and policy for appointment of teachers of high school, primary school and drawing was summoned by a full bench of the Sindh High Court comprising Justice Maqbool Baqar, Justice Sajjad Ali Shah and Justice Shahid Anwer Bajwa on Monday.

The bench was hearing three separate constitution petitions filed at Larkana and Hyderabad circuit benches and Karachi (principal seat) regarding appointments of teachers.

The chief justice formed the full bench after the Karachi and Sukkur benches rendered two different judgements. Allowing the petition, the Sukkur bench ordered issuance of posting orders to the petitioners, while the Karachi bench ordered only those candidates to be given posting/appointment who obtained 60 percent marks in the written test.

After hearing Justice (retd) Anwar Mansoor Khan, Navaid Ali Khokhar, counsel for petitioners and Sindh AAG Abdul Fatah Malik, the bench ordered the Sindh education department to lay the entire record of the tests, list of successful and failed candidates, policy and other relevant material on the next date of hearing. The bench adjourned further proceedings until December 21.

Petition adjourned until Nov 26: The hearing of a crucial petition soliciting orders of high court in respect of the lapsed National Reconciliation Ordinance (NRO) was adjourned until Nov 26 by a division bench of Sindh High Court comprising Chief Justice Sarmad Jalal Osmany and Justice Sajjad Ali Shah on Monday.

The petitioner, Syed Iqbal Kazmi (representative of the Human Rights Commission, South Asia in Pakistan) maintained through Advocate Mehmoodul Hasan that NRO had lapsed on Feb 28, 2009, and the government and its prosecuting agencies (NAB) were duty bound to take up the cases with the concerned courts of law from March 1, 2009.

He asked the court for directing the prosecuting agencies to recover public money worth billions of rupees that was usurped by the beneficiaries of NRO to be deposited in the treasury.

Adjourning further proceedings due to paucity of time, the bench fixed Nov 26 as the next hearing date.
